Appealing a Visa Refusal
If your visa application is refused, you may have the right to appeal the decision. Most personal visa refusals can be appealed to a tribunal or court, though some visas do not have this right, particularly if they were lodged offshore without a sponsor in Australia.
Your visa refusal notice will inform you whether you have the right to appeal, the timeframe for lodging the appeal, and the relevant appeal body. We recommend seeking immigration advice from a lawyer before lodging your appeal to assess your chances of success. In some cases, it may be more efficient or cost-effective to apply for another visa instead of appealing.
The most common appeal body is the Administrative Appeals Tribunal (AAT), which has strict deadlines for lodging appeals. It is crucial to read the appeal deadline in your refusal letter carefully, as AAT deadlines cannot be extended.
Some visa refusals, such as those based on character grounds decided by the Minister for Immigration, are appealed to the courts. For more information on this process, visit our Court Appeals page.
