Sponsorship obligations protect sponsored workers from exploitation and prevent local wages from being undercut. They include:
- paying all sponsorship and nomination costs, and not recovering them from the worker
- providing terms and conditions no less favourable than those for an Australian worker in the same role
- cooperating with inspectors and providing requested information
- keeping required records
- telling the Department about certain changes and events

Keep clear evidence that you are meeting your obligations, such as employment contracts and variations, payslips and pay records, and correspondence with the Department about sponsored workers. Good records make it much easier to respond if you are monitored.
Sponsors must notify the Department of certain events within set timeframes, for example when a sponsored worker stops working for the business or their duties change, or when business details change. Missing a notification can lead to sanctions.
The Department can take action against sponsors that don’t meet their obligations. Depending on the breach, this can include sanctions such as barring or cancelling sponsorship, infringement notices or court action. If you think a breach may have happened, get advice early.
