Reasons for Visa Refusal
Visa refusals can occur for several reasons, including:
- You did not meet the visa requirements when you lodged the visa application or by the time a decision was made.
- You did not provide complete information when you lodged your visa application.
- You did not respond to a request for further information about your visa application.
- You did not complete required steps such as completing a health examination.
- You provided false or misleading information.
- You did not provide enough evidence to support your application.
- You do not meet the character grounds for the visa.
- You do not meet the health requirements for the visa.
Options After Receiving a Visa Refusal
If you receive a visa refusal, you generally have two options:
- Appeal the Visa Refusal Decision
Most visa refusals can be appealed to the Administrative Appeals Tribunal (AAT) or relevant courts. Your refusal notice will detail if you have the right to appeal, the timeframe for lodging the appeal, and the relevant appeal body.
Appealing to the AAT: The AAT is the most common place for visa refusal appeals. It is crucial to adhere to strict deadlines for lodging your appeal. Unfortunately, these deadlines cannot be extended.
Court Appeals: In some cases, such as refusals based on character grounds, appeals are made to the courts. This process involves more technical legal arguments.

In some circumstances, applying for a new visa may be the best course of action, especially if your appeal is unlikely to succeed. To apply for a new visa, you must meet the requirements of that visa and not be subject to any visa bars.
Options After Receiving a Visa Refusal
To appeal a visa refusal decision, you must:
- Have received a visa refusal decision (attach this to your appeal application)
- Lodge the appeal paperwork with the relevant appeal body within the deadline
- Pay the relevant appeal fee (some appeals are free or have reduced/waived fees)
Most commonly, visa refusal appeals are lodged with the AAT. In some cases, you may need to appeal to the Immigration Assessment Authority (IAA), the Federal Circuit Court, the Federal Court, or the High Court of Australia.
Where Are Visa Refusal Appeals Heard?
Visa refusal appeals are generally heard at the AAT. Each Australian state and territory has its own AAT location. AAT hearings are typically in person, but can also be conducted via telephone or video conference. The AAT will inform you of your hearing details, including date, time, location, and interpreter arrangements if necessary.
If your appeal cannot be lodged with the AAT or you receive a negative decision at the AAT, you may appeal to a court. Court hearings differ from tribunal hearings and involve more technical legal arguments.
Applying for Another Visa After a Refusal
In some cases, you can apply for another visa after a refusal. To do so, you must meet the new visa’s requirements and not be subject to visa bars. Legal advice is recommended to ensure eligibility.
