On 14 October 2024, the Administrative Review Tribunal (ART) replaced the Administrative Appeals Tribunal (AAT). Matters that were still before the AAT moved across automatically, and the Immigration Assessment Authority closed on the same day.
What the ART can review
- Migration visa refusals and cancellations
- Protection visa refusals and cancellations
- Character-related refusals and cancellations
- Citizenship refusals and cancellations
- Nomination refusals, and sponsorship bars, refusals and cancellations
Deadlines are strict
The time limit depends on the type of decision and whether you are in immigration detention. The Tribunal has no power to extend it, so check the deadline in your decision letter as soon as it arrives.
Application fees
- Migration decisions: AUD3,727, with a 50% reduction for financial hardship. The fee must be paid before the review deadline.
- Protection decisions: AUD2,293, payable only if the Tribunal affirms the decision.
- Standard fee, including character-related decisions: AUD1,195.
Preparing for a review
Start with the reasons for the decision. A strong review application addresses each reason, provides new evidence where it helps and explains any gaps in the original application. Getting advice early gives you the most time to prepare.
